Resumo: dc.description.abstractSão José dos Campos is the most important city of the Vale do Paraíba. Center of excellence (in technological , educational, and administrative affairs) , attracts people who seek decent and affordable housing . This search has generated strong real estate speculation . The speculation can be understood as a strong increase in the price of houses in a certain town, state or country, whose causes may be explained by various means and the effects are felt throughout society . These effects range from difficulties in acquiring a house to economic turmoil that comes with the cease of demand , a instinctive market reaction in response to escalating prices . This kind of speculation is harmful to the municipality and the government itself , which is responsible for manage the damage done . The municipal government , as the major regulator of the life of the city , has an important role in disciplining of the use of urban space , through constitutional and legal mechanisms as the “Estatuto da Cidade” and the “Plano Diretor”. These laws allow urban planning having mechanisms that would mitigate real estate speculation . The objective of this work is to verify if the urban planning influences the real estate speculation on the outskirts of São José dos Campos , comparing the current situation of the municipality with the legal provisions that determine urban planning , its guidelines and priorities , taking into account the prevalence of social function of property in relation to individual property rights .pt_BR
